Topic: Transforming Trusts for Purposeful Impact
Delaware’s new Beneficiary Well-Being Trust statute offers an innovative approach to trust planning, one that goes beyond finances to support what matters most to families: personal growth, emotional health, and lasting legacy. The statute allows settlors to include provisions in a trust that direct trustees to consider a beneficiary’s overall well-being, not just financial needs, when making distribution and administration decisions. This presentation will cover:
• An overview of the statute and how it works
• Key drafting considerations for practitioners
• How to incorporate well-being provisions into trusts, whether in Delaware or other jurisdictions
• The practical impact on trustee-beneficiary relationships and family well-being
